The following
agreement is between Linda Greeson, hereafter referred to as
"Breeder"

fulfillment of the following conditions:
A. Purchase
price of $2500.00 (Two thousand five hundred) paid by the Buyer
to the Breeder
A non-refundable
deposit of
$500 as been made on

and the puppy will be held until ______________. At that time the balance of
the purchase price,
$2000, ( two thousand) must be
paid in full , either in a lump sum
or through payments received or the
deposit is forfeited and alternate
arrangements
will be made for the placement of the puppy.
B.
Transportation
costs, if any, will be paid by the Buyer.
Transportation costs must be prepaid before shipping.
(Airline charges, travel to airport expenses, plus kennel -
Approximately $350 at this time)

is further agreed by both parties that:
A.
Use
of the Dog
It is agreed between Breeder and Buyer that this dog is being acquired as
a family companion dog or
for a working dog to be used for tasks appropriate to its breed
such as therapy dog or for exhibition
in AKC conformation, obedience, or agility competition. Buyer
agrees that the dog is not purchased
for resale nor will it be used or trained for activities which are
illegal or for which it is not suited by
reason of temperament or conformation.
Specifically it will not be used as an attack dog or
to
hunt or fight other animals.
The Buyer agrees that he/she will not sell, transfer ownership or
possession of the puppy or any
of his/her progeny to any person or organization whose intent it is
to resell (pet store), trade, give
away the dog, use it in any experiments, laboratory or otherwise, or
to use it as breeding stock
for a puppy mill.
The Buyer agrees that the Mastiff will not be
leased/loaned or reregistered into a co-ownership
agreement/contract for purposes of breeding/showing unless authorized in
writing by the Seller
in writing prior to breeding or transfer of registration.
B
- HEALTH WARRANTEE...
Medical conditions covered by
warrantee:
The Mastiff is warranteed, excluding
conditions not covered below, to the age of twenty five
(25) months against bi-lateral hip dysplasia as diagnosed by the
Orthopedic Foundation
of America (O.F.A.)
The Mastiff is warranteed, excluding
conditions not covered below, to the age of twenty
five (25) months against bi-lateral elbow dysplasia ,consisting of
ununited anconeal
process, or fragmented coronoid process as diagnosed by O.F.A.
The Mastiff is warranteed to the age of
25 months to be free of genetic cardiac
conditions such as subaortic stenosis that would preclude it from
receiving a passing
cardiac certificate from OFA.
The Mastiff is warranteed to the age of
25 months against any heredity defect which would preclude the mastiff
from passing an Antech or Cornell laboratories VWD/ Von Willebrands
Disease test.
The Mastiff is warranteed to the age of
24 months against developing cystinuria as
diagnosed by Cystinuria research laboratory at University Of Pennsylvania.
The Mastiff is warranteed to the age of
24 months against developing primary epilepsy as diagnosed by a
board certified neurologist.
The Mastiff is warranteed for the life
against any hereditary defect that would prevent the
mastiff from receiving a PRA homozygous normal rating from Optigen Labs
via DNA testing.
The Mastiff is warranteed for the life
against any hereditary defect that would prevent the
mastiff from receiving a CMR1 normal rating from Optigen Labs via
DNA testing (non-affected).
C Conditions not covered by warrantee:
As sublaxation, OCD and HOD can be the results of poor
nutrition, improper exercise and/or
c excessive crating
no warrantee shall apply for these conditions. It is the Sellers opinion
that u
unilateral dysplasia is non-genetic and of injury or nutritional origin.
As DJD Grade 1 type elbow dysplasia or
unilateral elbow dysplasia can be the results of
poor nutrition, improper exercise, injury from jumping or
rough playing, no warrantee shall
apply for this condition.
As Thyroid disease is often the result of
improper nutrition the seller reserves the right to not warrantee this
condition.
As heartworm related cardiac disease is
brought on by neglect to properly care for the
Mastiff no warrantee shall apply for this condition.
No warrantee is given for Entropian or Extropian.
Since undescended testicles can be caused by injury
or other trama no warrantee is given for
retained testicles after the puppy is received by the buyer. Male
puppies have been examined
and verified to have both testicles descended by my veterinarian at
the time of health certification.
No warrantee is given for any condition if a male dog is
neutered before
the age of eighteen months.
Breeding the dog or bitch voids any warrantee.
Not supplementing the diet with NuVet Vitamins voids any
warrantee. NuVet vitamins must
be purchased from the Mastiff Sweet Spot or directly from
NuVet.com using
reference # 72793.
A final health check has been made by Breeders veterinarian and a
health
certificate is included in your new puppy packet.
The
Buyer agrees to have the Mastiff examined by a licensed veterinarian
within five (5)
working days from receipt of the Mastiff. If a problem is detected by the
veterinarian, the
Buyer may return the Mastiff for a full refund of purchase price. The
Buyer agrees to provide
a signed statement from the examining veterinarian detailing the health
problem. If the Buyer decides to keep the Mastiff, the Seller will not be
responsible for any veterinary costs
incurred. The Seller reserves the right to have the Mastiff examined by a
veterinarian of
the Seller's choice, at Seller's expense, for a second opinion of the
condition.
AKC registration papers will be sent to the Buyer after the veterinary
exam
and acceptance of the Mastiff by the Buyer.
If a puppy is thought to have
a genetic defect regarding it’s hips or elbows, that is covered under
the terms of
my warrantee, X-rays must be taken per
OFA recommendations and
submitted to The Orthopedic Foundation
for Animals (OFA). Puppy's
microchip number must be recorded on the xrays. Copies of OFA
findings must
be submitted to
the seller/breeder. Defects
must be proven to be genetic and not caused by environmental
factors or mishandling by the buyer, or feeding an improper diet.
The Breeder will present the veterinarian
reports to her veterinarian for
review to confirm
whether the defect is genetic in nature.
If a warranteed problem is found,
Buyer must show proof that puppy is spayed or neutered via a
vet
certificate (Buyer keeps his/her dog) and may obtain a replacement puppy
, when available, from
seller/breeder at 50% off of the original selling price. The breeder has done
everything possible to eliminate
hereditary diseases and problems by testing, care, pedigree planning
and selection.
Breeding the dog or bitch, or
not supplementing diet
with NuVet Vitamins voids any warrrantee.
Buyer is responsible for transportation costs on any replacement puppy.
C.
Registration:
The Breeder certifies that the dog is eligible for registration under the
Regulations of the American
Kennel Club as a purebred Mastiff and will provide the proper
forms for such a registration.
Buyer agrees that the Breeders kennel name prefix GREESONS will be at the
beginning
of the puppy’s registered name on the Registration certificate and understands
that
the puppy will be registered and named by the breeder. AKC
registration papers will be sent to
the Buyer after the veterinary exam and acceptance of the Mastiff by the
Buyer.
Buyer agrees not to change the registered name at any time..
D. Ownership
Responsibilities:
The Buyer agrees to maintain the dog in a humane environment and properly
train and care for it.
Specifically the dog will be properly licensed and Inoculated
against rabies, distemper, parvovirus,
and other communicable diseases as recommended by a qualified
veterinarian.
The dog will not be allowed to roam, will be socialized and obedience
trained appropriately.
The Breeders will microchip the
puppy before it is released.
The Buyer agrees that this puppy will not be raised on slippery surfaces,
or allowed to
bound up and down stairs, rough-house with larger dogs, jump
down from heights or out of
cars, etc, as this type of activity contributes to the breakdown
of joints and growing bones,
dislocation of shoulders, hips and damaged elbows.
The Buyer further agrees that the puppy’s weight will be under strict
supervision until the
dog reaches his/her second birthday. It is far better
to have the dog slightly underweight then
overweight, because excess weight contributes to structural
breakdown of the dog. Buyer also
agrees nothing will be given to the dog that would encourage
rapid growth; including steroids,
anything that promotes rapid weight gain and nutritional supplements other than NuVet
Vitamins,.
A high quality, low protein formula dog food is recommended after
this puppy has reached 2 years of age. .
The
breeder uses Eagle
Pack Large and Giant Breed Puppy Food supplemented with NuVet Vitamins.
and strongly
recommends that this puppy be raised on the same food.
Proper, balanced nutrition is extremely important every single day to a
growing mastiff puppy.
The
Buyer AGREES to feed NuVet Vitamins.

puppy and you may feed it anything you want.
You do not “have” to feed this food and vitamin supplement,
HOWEVER …..
I have 40 years of experience with nutrition in dogs
and I have learned the hard way what works
and what does not work.
I do not feel obligated to guarantee any puppy that is not fed
correctly
E. Spay
& Neutering:
Females which are purchased as family pets (non-breeding) and males which
are judged not to be
of show and breeding quality may be spayed or neutered when
they are near maturity if the owner
desires to do this - Recommendations are 12 months for females and 18 months for
male dogs.
Neutering male
dogs earlier than 18
months negatively affects growth and development.
Male dogs need proper hormones
to develop
body structure normally - without it they grow
tall and narrow and never develop
the width
and head type that they would grow if left intact.
There also seems to be
a higher incidence of bone
cancer in males that are neutered early.
F. "Show
Quality" and" Breeding Quality" Dogs:
The Breeders guarantee the health and the quality of the parents of this
puppy.
The Breeders will use their best judgment and the advice of other fanciers
and other Breeders in evaluating the puppies
as to show or pet quality.
There is no guarantee that a puppy
evaluated as "Show Quality"
will be successful in the show ring as an adult and no
warranties are made to that effect.
The Breeder encourages owners to participate in the sport of purebred dogs and
will assist
Buyers with advise in preparing and showing dogs which are evaluated to be of show
quality.
The breeder also has no controll over the breeding potential of any
puppy as an adult and makes
no warrantee as to the success of this animal as breeding stock.
G.
Right
of Recovery/Placement:
In the event that the Buyers are unable to keep the dog or provide an
appropriate home in
accordance with this agreement, the
dog with its title/registration will not be transferred to
any person or organization other then the Breeder, whether by sale, gift,
loan or otherwise,
unless agreed to by the Breeder in writing. Buyers
agree to notify the Breeder if any such
contingency arises and will not abandon the dog to a shelter or sell or
give the dog away. If dog is
found to have been sold or given away without Breeders knowledge and
said breeder discovers this,
Breeder will take legal action and original Buyer of the dog will be
responsible for all legal expenses
incurred. The Breeder wishes to ensure that this dog is always
in a place where he/she will be
properly cared for. The Breeder will always take back this dog , at
no expense to the breeder,
and keep and care for the dog until a suitable home is found.
This contract is under the jurisdiction of the state of
Florida, in the county of Lake. It is agreed
the place of venue shall be in Lake County, Florida. Any breech of
this contract could be detrimental
to the name and reputation of the breeder/seller and the breeder/seller
will be entitled to 5 times the
purchase price of the puppy including but not limited to attorneys fees,
court cost, any and all
expenses acquired and (or) the
puppy back. All other states and counties are asked to
please accept this contract as legally binding and enforceable.
LIMITATION OF LIABILITY.
In no event will Breeder be
liable for any incidental or consequential damages including, without
limitations,
loss of profit and claims of third parties, however caused. All questions
concerning the validity, operation,
interpretation and
construction of this Agreement shall be governed by and determined in
accordance
with the laws of the State of
Florida. In the event that any
one or more provisions contained in this Agreement
should, for any reason, be
held to be unenforceable in any respect under the laws of any state or of
the
United States, unenforceability shall not affect any other provisions of
this Agreement, but this Agreement
shall be construed as if
such unenforceable provisions had not been contained herein.
This
contract is designed to protect the Mastiff and its future offspring, the
Breeder
and the Buyer of said Mastiff. By signing, all parties agree to
all clauses of this contract.
Buyer agrees that he/she has read and understands the terms and conditions
